Terms of Service

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

2. Your account

To access certain features you must create an account. You agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@insightesportsapp.com if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms.

3. License to use

Subject to these Terms, Insight grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, or sublicense any part of the Service.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• Post or transmit content that is abusive, harassing, hateful, defamatory, obscene, or otherwise objectionable;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Attempt to gain unauthorized access to any part of the Service or its related systems;
• Use automated tools, bots, scrapers, or scripts to access or interact with the Service without our written permission;
• Interfere with or disrupt the integrity or performance of the Service;
• Use the Service to transmit spam, malware, or other harmful code;
• Reverse engineer, decompile, or disassemble any portion of the Service.

5. User content

The Service allows you to post messages, votes, and other content ("User Content"). You retain ownership of your User Content, but by posting it you grant Insight a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute that content in connection with operating and improving the Service.

You represent that your User Content does not violate any third-party rights or applicable law. We may remove User Content and suspend or terminate accounts that violate these Terms or our community standards, at our sole discretion.

6. Premium subscriptions

Certain features of the Service require a paid subscription ("Premium"). Subscriptions are available through Apple in-app purchase or through our website via Stripe.

• Billing. Subscriptions are billed on a recurring basis (monthly or annual, as selected). Your subscription renews automatically unless cancelled before the renewal date.
• Cancellation. You may cancel at any time through your Apple ID settings or your account settings on our website. Cancellation takes effect at the end of the current billing period; we do not provide partial refunds for unused time except as required by law or Apple's policies.
• Price changes. We may change subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new price.
• Refunds. For purchases made through Apple, refund requests are handled by Apple in accordance with their policies. For purchases made through our website, contact us at support@insightesportsapp.com.

7. Intellectual property

The Service and its original content (excluding User Content), features, and functionality are and remain the exclusive property of Insight GG LLC and its licensors. The Insight Esports name, logo, and related marks are trademarks of Insight GG LLC. You may not use our marks without our prior written permission. Esports data, team names, player names, and game assets displayed in the Service are the property of their respective owners and are used pursuant to applicable licenses and policies.

8. Third-party services

The Service integrates with third-party services including Riot Games, Apple, Stripe, and Anthropic. Your use of those services is governed by their own terms and policies. We are not responsible for the practices or content of third-party services.

9. AI-generated content

Some features of the Service, including our premium weekly reports, use artificial intelligence to generate content. AI-generated content is labeled as such within the Service. While we work to make this content useful, it may be inaccurate, incomplete, or out of date, and it is provided for informational and entertainment purposes only.

You should not rely on AI-generated content, predictions, or win probabilities for betting, wagering, investment, or any other financial or legal decisions, and you are responsible for independently verifying any information before relying on it. AI features are powered in part by third-party providers, including Anthropic, whose handling of data is described in our Privacy Policy. If you believe AI-generated content is inappropriate or violates these Terms, you can report it through the in-app reporting tools or at support@insightesportsapp.com.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. ESPORTS DATA, STATISTICS, AND AI-GENERATED CONTENT ARE PROVIDED FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR ANY FINANCIAL OR WAGERING DECISIONS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSIGHT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO INSIGHT IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless Insight GG LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Accessibility

We are committed to making the Service accessible to as many people as possible, including users with disabilities, and we aim to follow the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as a guiding standard. Accessibility is an ongoing effort, and some parts of the Service may not yet fully conform.
